"The System Has Failed" was originally intended to be a Dave Mustaine solo album, but for contractual reasons was released under the Megadeth name. Mustaine originally stated that it would be the final Megadeth album, but later announced that the band would continue as normal. It is the first Megadeth album not to feature David Ellefson, though the presence of Chris Poland means it is not the first to feature only Dave Mustaine from the first album recording line-up.

The lyrics of "Shadow of Deth" are taken from Psalm 23.

Music videos were made for "Die Dead Enough" and "Of Mice And Men".
On September 14th, 2014 the music video for 'Back in the Day' was released (done in 2004).
